B Based on a post a while back where I found an image of mine being used on the Main Home Page of O.P. Magazine, I did a little info digging.
I noted when posting any images to the Favorite Places gallery with a write up there isn't any release of copyrights or credit or usage agreement or diclaimer. When the question was raise to me if i were being paid for the use of my image outside of the location i posted it to, i had to really stop and think. The answer was No, but at the time i wasn't sure if i had signed away anything that would preclude me from getting payment. What burned my hide was the lack of Photo Credit with the image being used. it is clearly being used as a marketing tool to draw attention to a particular section of the site.
there fore I called OP Mag and Werner Publishing and they were dumbfounded and had no answers for me. Today i was handed over to the OP Mag Editor who is incharge of the web and was told he was out of town. "Of course he is." I also contacted a couple other photographer's whos images are being used in the same way to see what they know too.
Needless to say I am disappointed by the stance OP is taking so far and their lack of real response to the matter. it is a shame that such a publication should resort to this type of business.
Anyway, I'm ranting but wanted to warn others to be careful and diligent with image submisions.

So they used an image that you had posted to "Your favorite places" elsewhere on the site to attract attention to that feature without consent or credit?
Seems like bad form.
Did your original posted image have a copyright stamp in it? If so, is that copyright visible in the image they used or was it cropped out? That would be very bad form.
No I did not watermark the shot, but it was taken from a page where there is a Copyright notice and my name.

Well today was fruitful. I got a call from the Senior Editor at OP and he was bothered too by the oversight and is fixing the lack of Photographer's Credit. I wasn't worried about getting paid for the shot as I told him, I just felt it was only right to have credit for the work done. he agreed and is getting it fixed. He was also happy that I pointed out a problem where someone had submitted a link to a Pharmacutical Site for Viagra in to the Favorite Places section so that he could get that fixed and removed too!
OP is a first-rate publication and I'm happy to hear they took care of the problem. You can bet they want to continue their outstanding reputation and work with the top pro photographers in the world.
