Got this email today and am flattered but do not know how to respond. After all, it was I that came up with the composition and did the leg work. I'm not sure how I feel about someone duplicating it as a painting and calling it theirs. I do however respect the fact that they emailed to ask permission instead of simply using my image from the web. Here is the email...

"I am a visual artist and am preparing for an exhibition of arcylic paintings with tthe theme of Canadian landscape, in Coquitlam BC, 2010. I found your photograph of Whirlpool Pt Bighotn WWildland Alberta on the web and would like your permission to use it as reference in creating a painting represenive of Alberta. Thanks for your consideration."

Thanks in advance for any thoughts on how to address this.

Wayne,

This topic was recently discussed in the Digital Imaging forum.

Cheers,

The usage is crucial. Theres a huge difference between hanging it in your living room and hanging it up for sale. Make sure you know how the result will be used.

Thanks for your feedback guys, I visited the other thread that Mark suggested checking out. It was suggested in that thread that the photographer should get a cut of the sale of the painting if it is agreed that the image may be used. I have emailed this person back and asked for 20% of the sale as well as credit for my photo being used as reference and she has agreed with no problems. I think it is a good arrangement for both of us and a good way to bring in a little extra income. I have certain photos that I would never do this with, but in this particular case I feel okay about it. I feel that this artists' style would lend itself well to this particular image as it is a kind of painterly looking image to start with.

Kudos to the visual artist! Can you imagine how many times this is done without getting permission????

Carol,
My thoughts exactly! She even insisted on a contract for my peace of mind... I think I got pretty lucky with such an honest artist coming forth and doing things the right way.
