He was in with a group of least sandpipers and just about the same size. He actions seemed a little more hurried and nervous. Thanks in advance for the help. I was thinking semipalmaited sandpiper or sanderling. I just think he is a little small to be a sanderling???

looks good for a Semipalmated Sandpiper to me, Mike. A Sanderling is larger than a Least Sandpiper and shows more primary projection (totally lacking here). Bill shape is just right for a semi too.
Black bill with a slight droop at the tip, black legs, a white eyebrow (technically, a supercilium), faint streaking in the chest and a peep in North America pretty much has to be a Semipalmated Sandpiper. As Brian noted, the tips of the primaries don't extend past the tip of the tale, which also limits it to a peep. Good photo, BTW.
