I open smart sharpen, make the change with the sliders, preview is checked I see the changes on the image plus the smart sharpen box but soon as I accept, click ok progress bar comes up. Then as soon as the progress bar vanishes the image goes soft again. Too see if my eyes were playing games on me I did a CTRL Z(undo state change) and noticed no difference in the image. This never used to happen it used to stay the way I saw it once clicking ok. What could be going on here? (I am using CS4 if that helps)

Just for a laugh I tried using Unsharp Mask, those changes hold, but I don't like the look of the sharpening so this is not an option.

Yikes, sounds like the classic corrupted preferences file. I would try resetting that first, 90% of the time that'll work. Do this:

¨ Close Photoshop
¨ Hold down Shift+Ctrl+Alt and keep 'em down.
¨ Start Photoshop
¨ Say YES when Photoshop asks to delete the preferences file.

The one bad thing is that I'm fairly sure that custom key commands and menu settings such as color get wiped. You won't lose Actions you've made, but changes in the environment will go back to default, as if you just installed PS new.

Try that, and if it doesn't help we'll try other things.
