Sadly Andy I fear this will go straight through without any challenge which means sites like this will be an even bigger photo library for those who just lift images for their own gain! Although it already happens now, but it will be even more blatant
Andy
Not sure if this is the right act or whatever but its frightening!
6.What is fair dealing?
Fair dealing is a term used to describe some limited activities that are allowed without infringing copyright. Briefly these are as follows:
i.Research and private study
Copying parts of a literary, dramatic, musical or artistic work or of a typographical arrangement of a published edition for the purpose of research or private study is allowed under the following conditions:
•The copy is made for the purposes of research or private study.
•The copy is made for non-commercial purposes.
•The source of the material is acknowledged.
•The person making the copy does not make copies of the material available for a number of people.
ii.Instruction or examination
Copying parts of a literary, dramatic, musical or artistic work or a sound recording, film or broadcast for the purpose of instruction or examination is allowed under the following conditions:
•The copying is done by the student or the person giving instruction.
•The copying is not done via a reprographic process.
•The source of the material is acknowledged.
•The instruction is for a non-commercial purpose.
Time to cover all photos with serious copyrights. Post 350px images on forums. Forget selling images. On top of that we will have to pay for Photoshop all the time, no more using version 7 until the cows come home.
This has been long coming, and very few listened to the warnings given years back . It's too late to stop the act now as it's been voted through, so signing the petition won't do anything.
However, on a slightly brighter note, it appears there is a lot of FUD (fear, uncertainty, doubt) surrounding the orphan works element and the Intellectual property office has released a set of Q&A's about the new legislation... you can read their take on it here
The worrying bit is what happens if the fee they collect (and deduct their costs from no doubt) is less than you are willing (or have already) licensed the image for. Will you still be entitled to claim the effective loss and make up the fee? And what if they've used an image which you were not willing to license, or which had exclusivity... There are still a lot of questions to be answered, and I guess they'll have to be tested via the courts .
I dunno, I suppose by being sensible and only posting low res small images we are protecting are self as much as we can as their usefulness is greatly reduced. Leaving fullres version of an image on the web is a bit like leaving your car unlocked and being surprised something got nicked!

The risks of this new legislation are hard to quantify as yet by all accounts, but the bill seems to have had an unnaturally speedy passage thus far.
