A brief update on the recent Orphan Works legislation ....
When Andy mentioned the Orphan Works legislation in this post back in May I added a link to some clarifying info that the IPO had published and commented that there was no information about what happened with the licensing once the Copyright holder comes forward to claim the 'orphan'.
Yesterday I had a chance to speak to a nice chap from the IPO and he said that (while things aren't fully worked out yet) he understood that the following points would apply:
- The license granted under Orphan works would be limited in scope and time, not a blanket & indefinite free-for-all.
- That fees collected would most likely be in line with market trends at the time the orphan license was granted.
- If/When the copyright holder came forward to reclaim the 'orphan', the license previously granted would lapse at that point (hence why the license is limited).
- The copyright holder would then be free to negotiate a new license/fee under their terms, or to withdraw permission for use.
He didn't say if there would be a 'commission' deducted by the orphan licensing/collecting agency though
